Lász­ló Öllös: The Con­sti­tu­tion of the Hun­gar­i­an Repub­lic and the Hun­gar­i­an Minori­ties

The re­fe­ren­dum on dou­ble nation­al­i­ty even showed one of the sys­tem­at­i­cal­ly grow­ing con­flicts from the sys­tem changes of the Hun­gar­i­an pol­i­cy, name­ly, that in con­nec­tion with the Hun­gar­i­ans liv­ing out­side the ter­ri­to­ry of Hun­ga­ry, there is no agree­ment between the Hun­gar­i­an polit­i­cal pow­er­s. Despite that the deter­min­ing direc­tions of the sys­tem changes were able to agree on the text of the con­sti­tu­tion, the issue of the Hun­gar­i­an minori­ties still result­ed sys­tem­at­i­cal­ly appear­ing, strong pres­sures, unsolved con­flicts in the Hun­gar­i­an polit­i­cal life. With the exam­i­na­tion­s, main­ly rely­ing on the prin­ci­ples of con­sti­tu­tion­al­i­ty, the author wants to give rea­son that since the issue, even if gen­er­al­ly, is pres­ent in the Con­sti­tu­tion of the Hun­gar­i­an Repub­lic, it results con­sti­tu­tion­al agree­ment in the basic issues relat­ing Hun­gar­i­ans out­side the bor­der­s. The author also exam­ines the moral bases of con­sti­tu­tion­al agree­ment that has been or can be evolved on the issue. Lat­er, argu­ing with the value sys­tem of con­sti­tu­tion­al agree­men­t, he con­firms that from the text con­sti­tu­tion­al respon­si­bil­i­ties arise. From the text itself, it is not evi­dent that it is respon­si­ble for the Hun­gar­i­an state and one of the group of the Hun­gar­i­an minori­ties. The text of the con­sti­tu­tion does not even clas­si­fy Hun­gar­i­ans liv­ing out­side the bor­der­s, that is there is no word about Hun­gar­i­ans of first, sec­ond, or third class. Con­se­quent­ly, nei­ther the lack of respon­si­bil­i­ty to the Hun­gar­i­ans of the Hun­gar­i­an state can­not be orig­i­nat­ed, nei­ther respon­si­bil­i­ty to cer­tain groups of minor­i­ty Hun­gar­i­an­s. There­fore it is an insuf­fi­cient stand­point to adjust the sup­port of minori­ties to the recent­ly actu­al Hun­gar­i­an power inter­est­s.
