László Öllös: The Constitution of the Hungarian Republic and the Hungarian Minorities
The referendum on double nationality even showed one of the systematically growing conflicts from the system changes of the Hungarian policy, namely, that in connection with the Hungarians living outside the territory of Hungary, there is no agreement between the Hungarian political powers. Despite that the determining directions of the system changes were able to agree on the text of the constitution, the issue of the Hungarian minorities still resulted systematically appearing, strong pressures, unsolved conflicts in the Hungarian political life. With the examinations, mainly relying on the principles of constitutionality, the author wants to give reason that since the issue, even if generally, is present in the Constitution of the Hungarian Republic, it results constitutional agreement in the basic issues relating Hungarians outside the borders. The author also examines the moral bases of constitutional agreement that has been or can be evolved on the issue. Later, arguing with the value system of constitutional agreement, he confirms that from the text constitutional responsibilities arise. From the text itself, it is not evident that it is responsible for the Hungarian state and one of the group of the Hungarian minorities. The text of the constitution does not even classify Hungarians living outside the borders, that is there is no word about Hungarians of first, second, or third class. Consequently, neither the lack of responsibility to the Hungarians of the Hungarian state cannot be originated, neither responsibility to certain groups of minority Hungarians. Therefore it is an insufficient standpoint to adjust the support of minorities to the recently actual Hungarian power interests.
